What is diminished value?
The “loss of value” of an automobile after an accident occurs. NC has long held the proper measure of damages in an automobile accident case, is the difference between the faire market value of the vehicle immediately before the accident and immediately after the accident. “The market value” is defined to be the amount, which will be agreed upon by an owner who wishes to sell but not compelled to do so and a buyer who wishes to buy and is not compelled to do so.
Facts of diminished value
When an individual is in an automobile accident caused by another party, and the loss is greater than 25% of retail value of their vehicle, North Carolina Damage Disclosure Statue 20-71.4 states that any such damages must be disclosed to the next potential buyer. Such individuals are entitled to recover any diminished value.
A large percentage of the population is unaware that they are entitled to the diminished value of their vehicle in addition to the repair costs.
